Reflections on the Ecuadorian constitutional justice

The December 14 was presented at the Universidad del Azuay the book "Reflections on the democratic legitimacy of constitutional justice in Ecuador", by professor-researcher Sebastián López.

The work is the product of doctoral thesis research to opt for the title of Doctor, PhD in Constitutional Law by the Universidad Andina Simón Bolívar and the University of Seville-Spain, and at the time received the qualification Cum Laude by the doctoral court .

"I hope that this publication - and given the current legal situation around the Constitutional Court - can become a benchmark for consultation on the actions of constitutional justice in our country," said Lopez, who is also Assistant Dean of the Faculty of Sciences UDA Law, and added:

“Democratic criticisms of the constitutional control body have been incisive due to the anti-majority character of constitutional justice; However, with this publication it becomes clear that this theory, at least in Ecuador, does not fully adapt because constitutional justice here has been deferential to the exercise of political power in turn, which invites us to reflect on the horizons that the Court must assume as the true guardian of fundamental rights in a democracy ”.

The book is aimed at Constitutional Law professionals fundamentally, but also students and legal operators in general who debate on a daily basis about the true role that the high courts must fulfill within the Constitutional State of Rights and Justice implemented following the Constitution of 2008 .
